Welcome to Aloba. The terms “we”, “us” and “our” refer to Alobawear Ltd (“Aloba”). We operate this store and website, including all related information, content, features, tools, products and services (the “Services”) to provide you with a curated shopping experience. Our store is hosted on Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”) describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using our Services (including placing an order), you agree to be bound by these Terms and any policies referenced in them (including our Privacy Policy and Returns & Refunds Policy). If you do not agree, you should not use the Services.
1. Access and accounts
To use the Services, including making purchases, you may be asked to provide certain information such as your email address, billing details, payment information, and shipping information. You represent and warrant that the information you provide is accurate, current, and complete.
You are responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.
2. Our products
We aim to display product information as accurately as possible. However, colors and appearance may vary depending on your device and settings. We do not guarantee that the appearance of products on your screen will exactly match the delivered product.
Product descriptions, pricing, and availability may change at any time without notice. We may discontinue products or limit quantities available to any person, region, or jurisdiction.
3. Orders
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is not accepted until we confirm acceptance (for example, by sending an order confirmation). We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting. We may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, change, or cancel an order, we will attempt to notify you using the contact details provided at checkout.
Purchases are subject to our Returns & Refunds Policy (see: Returns & Refunds Policy link). Purchases are for personal or household use only and not for commercial resale or export.
4. Prices and billing
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed and will be shown in your order confirmation.
You agree to provide current, complete, and accurate purchase and payment information. You represent and warrant that you are authorised to use the payment method provided and that charges will be honoured by your payment provider.
5. Shipping and delivery
Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processes, or events outside our control.

6. Preorders
Some items may be offered on a preorder basis. Any preorder timelines shown are estimates unless explicitly stated otherwise on the product page.
Unless stated otherwise, you may cancel a preorder before it ships for a full refund. Preorder terms may be described on the product page and/or in our policies.
7. Intellectual property
The Services and their content (including trademarks, logos, text, images, graphics, videos, and design) are owned by Aloba and/or its licensors and are protected by applicable intellectual property laws. These Terms permit you to use the Services for personal, non-commercial use only.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit material from the Services without our prior written consent, except where permitted by law.
Shopify and related names and marks are trademarks of Shopify. All other names and marks are the property of their respective owners.
8. Optional tools
We may provide access to third-party tools as part of the Services. These tools are provided “as is” and “as available”, and we do not monitor or control them. Your use of optional tools is at your own risk.
9. Third-party links
The Services may include links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third parties. If you choose to access third-party sites, you do so at your own risk.
10. Relationship with Shopify
Our store is powered by Shopify, which enables us to provide the Services. However, any purchases you make are made directly with Aloba. Shopify is not responsible for any aspect of sales between you and Aloba, including any injury, damage, or loss resulting from purchased products or services. To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising from your purchases and transactions with Aloba.
11. Privacy
Personal information we collect through the Services is subject to our Privacy Policy (see: Privacy Policy link). Because the Services are hosted by Shopify, Shopify may collect and process personal information about your access to and use of the Services in order to provide and improve them.
12. Mobile SMS Terms of Service
The Aloba mobile message service (the "SMS Service") is operated by Aloba. Your use of the SMS Service constitutes your agreement to these mobile terms. We may modify or cancel the SMS Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these mobile terms at any time and your continued use of the SMS Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Aloba's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Aloba through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Aloba. Your participation in this program is completely voluntary.
We do not charge for the SMS Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the SMS Service at any time. Text the single keyword command STOP to Aloba or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Aloba mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the SMS Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the SMS Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the SMS Service, any errors in such information, and/or any action you may or may not take in reliance on the information or SMS Service.
13. Feedback
If you submit ideas, suggestions, feedback, or reviews (“Feedback”), you grant us a worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish, distribute, and display your Feedback for any purpose, including commercial use, to the extent permitted by law.
You represent and warrant that you own or have the rights necessary to submit Feedback and that your Feedback does not infringe the rights of any third party or violate applicable law.
14. Errors, inaccuracies, and omissions
Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, shipping charges, transit times, and availability. We reserve the right to correct errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you submit your order).
15. Prohibited uses
You may use the Services for lawful purposes only. You must not misuse the Services, interfere with their security, transmit malware, attempt unauthorised access, or violate any applicable law or the rights of others.
We may suspend or terminate your access to the Services if we believe you have violated these Terms.
16. Termination
We may terminate these Terms or your access to the Services (or any part of them) at our discretion, without notice, to the extent permitted by law. You remain liable for amounts due up to and including the date of termination.
17. Disclaimer of warranties
To the fullest extent permitted by law, the Services and all products offered through the Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.
18. Limitation of liability
To the fullest extent permitted by law, Aloba and its directors, officers, employees, affiliates, agents, contractors, service providers, and licensors (and Shopify and its affiliates) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, savings, data, or goodwill, arising out of or relating to your use of the Services or products purchased through the Services.
19. Indemnification
You agree to indemnify and hold harmless Aloba (and Shopify and their affiliates) from claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.
20. Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
21. Entire agreement
These Terms and any policies referenced herein constitute the entire agreement between you and Aloba regarding your use of the Services and supersede any prior agreements or understandings.
22. Governing law and dispute resolution
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Ireland.
Where available and appropriate, we will participate in alternative dispute resolution (ADR) processes.
23. Changes to these Terms
We may update these Terms from time to time by posting an updated version on this page. It is your responsibility to review these Terms periodically. Changes will be effective when posted unless otherwise required by applicable law. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
